These Terms of Business (“Terms”) govern all purchases made through this website and outline the obligations and legal conditions between Telasja Sp. z o.o., a company registered in Poland (NIP: 5253015684, Registered Office: ul. Kalwaryjska 69 lok 9, 30-504 Kraków, Poland), and the buyer.

By accessing this website and purchasing our products, you agree to be bound by these Terms in accordance with the laws of Poland and the United Kingdom, where applicable.

 3.1 Due Diligence 

Buyers must:

• Be aged 18 or above.
• Submit proof of ID upon request.
• Confirm the purpose of purchase is food-grade, medical, or industrial.

 3.2 Authorisation 

Business buyers must declare whether:

• They are the beneficial owner of the business; or
• They are acting on behalf of a company with valid authorisation (documented proof required).

 3.3 Import & VAT Responsibility 

Where applicable, the buyer:

• Takes responsibility for customs clearance within 3 months.
   
• Understands and agrees to VAT reverse charge mechanisms under intra-community rules.
   
• Indemnifies Telasja Sp. z o.o. from any tax liabilities due to misreporting.

2.1 Product Use Limitation

Telasja supplies N₂O cream chargers and medical gas solutions strictly for legitimate culinary, medical, or industrial use. You agree:

• Not to misuse N₂O or any gas products for recreational purposes.
• Not to inhale, encourage, sell or distribute for misuse.
• To take all measures to prevent resale or distribution to individuals under 18 or those intending misuse.

2.2 UK-Specific Restrictions

In line with the UK Psychoactive Substances Act 2016 and relevant Home Office guidance:

• Sales for psychoactive use are strictly prohibited.
• Any product suspected to be diverted for recreational misuse will result in refusal of sale and potential reporting to authorities.

2.3 Polish Regulatory Compliance

The buyer confirms compliance with Ustawa o przeciwdziałaniu narkomanii (Act on Counteracting Drug Addiction) and any relevant Polish Ministry of Health regulations.

• Telasja's liability is limited to the replacement or refund of the purchased goods in accordance with applicable warranties and industry standards.
• Telasja shall not be held liable for:
• Any misuse of products.
• Consequential damages, health issues, or injury from inhalation or mishandling.
• Buyer agrees to indemnify Telasja against all claims, penalties, legal costs or damages arising from misuse, resale for misuse, or regulatory violations.

 Buyers must:

• Follow EU and Polish transport and storage regulations for compressed gases.
• Ensure personnel handling gases are trained and insured.
• Store gases in well-ventilated, temperature-regulated environments, away from flammable substances.
   

 Any confidential or proprietary information shared by Telasja must:

• Not be disclosed without prior written consent.
• Be protected against unauthorised access.
• Remain confidential for five (5) years post-relationship termination.

• Orders may be refused if there is suspicion of illegality or misuse.
• Products will not be shipped to jurisdictions where N₂O is banned or controlled without a valid license.
• All sales are subject to availability and verification checks.

All personal and corporate data is processed and stored according to:

• Polish GDPR implementation law (RODO).
• UK Data Protection Act 2018 for UK clients.

• These Terms are governed by the laws of Poland, and where applicable, UK law.
• Any dispute shall be submitted to the exclusive jurisdiction of the courts of Kraków, Poland, unless otherwise mandated by consumer law.
   

 By using this website or placing an order, the buyer confirms:

• They have read, understood, and agreed to these Terms.
• They are acting within legal capacity and with lawful intent.
